The sharing of homelessness personal data with the Department for Levelling Up, Housing and Communities (DLUHC)

The Council is working with DLUHC as part of the Homelessness Data England Project to improve the service and provide support to people who are homeless or threatened with homelessness. This will involve the sharing of information and personal data.

DLUHC will be using information about how you have become homeless (or threated with homelessness), your housing history and the sort of things that you need help and support with.

To carry out research and provide support, the Council will share personal information. This may include your name, date of birth, gender, last known address, and national Insurance number (if known).

Information will be linked to existing data already held by DLUHC and other government departments.

Any information you provide will not be used to make any decisions about what benefits you get, services you use, now or in future, or used to identify fraud. It can only be used for research.

Personal information you provide will be kept secure and strictly confidential; it will be held separately from all the other information in a secure, password-protected document on a computer system. You will be assigned a unique reference number, so that even though a researcher will see your information, they will not be able to identify you.
 

Special Category & Criminal Offence Data

Some of the information collected and processed will be classified as special category or criminal offence personal data under GDPR Article 9 & 10.

Where special category personal data is processed, the condition relied upon is Article 9(2)(g) of the UK GDPR. DLUHC will rely on meeting the condition in Schedule 1, Part 2, paragraph 6 of the DPA 2018 to process special category personal data in accordance with section 10(3) of the DPA 2018.
 

Lawful Basis for Processing

The lawful basis for sharing personal data is GDPR Article 6. (1)(e) Public Task: the processing is necessary to perform a task in the public interest or for official functions, and the task or function has a clear basis in law. The Council will be relying on section 1 of the Localism Act 2011 and powers under section 111 of the Local Government Act 1972.
 

Other Recipients of Personal Data

As well as DLUHC receiving the personal data, The Office for National Statistics (DLUHC’s partner on this project) will keep your personal identifiers and store them securely – this is to track the longer-term outcomes for those who have been homeless or at risk of homelessness.

A review will be carried out every five years to ensure the data is still required. If it is not required, it will be securely deleted. This information will be shared with ONS by DLUHC.
